SKILLED WORKER VISA

On 31 December 2020 the UK implemented a new Points-Based Immigration System which enables employers to recruit individuals to work in the UK known as the Skilled Worker Visa.

 

The Skilled Worker route is for European Economic Area (EEA) nationals (arriving from 1 January 2021) and non-EEA nationals who are sponsored to do a specific skilled job for a Home Office licensed sponsor. Individuals of all nationalities (except British and Irish) are eligible for the Skilled Worker Visa. (Please note, throughout this document, references to EEA nationals include Swiss nationals.

 

Dependent partners and children can apply on this route, as set out in the dependants guidance. The route can lead to settlement in the UK. The route replaces the Tier 2 (General) route and no new applications can be made under this route. Existing Tier 2 (General) workers can apply for extensions, changes of employment and settlement under the Skilled Worker route.

To be eligible for a Skilled Worker visa, you must have been offered a skilled job in the UK which meets certain skills, salary standards and is employed by an employer in the UK who holds a valid sponsorship license.

The applicant's employer must provide a certificate of sponsorship (CoS). CoS provides details on the migrant and the proposed employment. The visa or Leave to Remain (LTR) will be granted for the time period specified in the CoS.  

Although the majority of the conditions for the Skilled Worker visa remain the same as for Tier 2 (General) visa, there are some significant changes, such as

  • the minimum employment skill level has been reduced from RQF Level 6 (e.g., degree level) to RQF Level 3 (e.g., A-levels/Scottish Highers level)

 

  • the minimum wage level being lowered from £30,000 to a minimum of £25,600 (or the ‘going rate' for the position, whichever is higher)

  • Sponsored employees earning less than £25,600 a year could also be liable for sponsorship by a combination of 'tradeable points.'

  • Sponsors are not required to conduct a Resident Labour Market Test however, positions must be ‘genuine' and satisfy the competence and wage requirements.

  • The 12-month ‘cooling off period’ and six-year maximum length of stay in this route has been removed which provides greater flexibility

 

Therefore it is now easier to switch from other immigration categories to the worker category and is indeed a delightful update for individulas looking to work and settle in the UK.

Requirements

The applicant must

  • be aged 18 or over on the date of application.

  • have a job offer at an appropriate skill level.

  • have a certificate of sponsorship that was issued to them by their sponsor no more than 3 months before the date of application.

  • show they meet the English language requirement.

  • meet the financial requirement.

  • have enough money to support them without relying on public funds

  • have a criminal record certificate (if applicable)

  • provided a valid TB certificate (if applicable)

  • If applying for permission to stay the applicant must not be:
                       (a) in breach of immigration laws
                       (b) on immigration bail.
     

Eligibility 

To be qualified for a Skilled Worker Visa, the candidate must receive a total of 70 points. This constitutes of 50 points for obligatory or 'non-tradeable' requirements and 20 points for 'tradeable' criteria.

If a individual is applying for entry clearance from outside the UK or has been in the UK for less than a year at the time of application, they must illustrate sufficient funds to support themselves and all family members in the UK.

Investigating Stage

REGISTRATION

​​​Inorder to assist you with your application for a skilled worker visa, an initial assessment has to be conducted to identify the type of job you can apply for and a suitable licensed sponsor who can have you on board by offering you a skilled position. For the initial assessment we will require the following

  • Fill in the 

  • Provide the required documentation 

  • Payment of £1500 for the assessment.

  • Biometric Residence Permit (BRP) both sides (if applicable)

  • All educational documents since 10th grade

  • All work experience documents.

ASSESSMENT

Once we have received all the requested documentation we would assess which working sector /  department would be best for you.Therefore before we proceed with a case we would want to find out more about you and your interests at this stage so at the end of this stage we will have a better understanding about you and your aspirations and be able to assess your application and find you a suitable sponsor. 

 

At this stage

  • We schedule an appointment to have a discussion with you over the phone, video call or via chat whichever is convenient for you.

  • We analyse your interests, aspirations and find out the sector / department that will be best for you.

  • We would prepare a profile for you and share it with the licensed employers we work with.

Application Stage

APPLICATION TO THE SPONSOR 

When we receive a response from the sponsors who are interested in your profile. We will share  details of the sponsors to you and you have the choice of either completing the application yourself or instructing us to assist you in completing your formal application to the Sponsor.

At this stage 

  • You will receive a detailed and tailored list of the documents to be submitted in support of your application. 

  • We will assist you prepare the bundle of evidence and review of all documents and evidence you have provided us in support of your application.

  • Our experts will let you know if any documents are missing. If you have not been able to obtain certain key evidence, we will advise you on other ways of proving that you meet the requirements of the immigration rules.

  • We will provide the applicant with necessary tips, advice and the most relevant resources to prepare for the interview inorder to have the best chance for a successful outcome.

At this stage you will be required to pay a fee to continue with the process.

INTERVIEW 

 

A formal interview will be scheduled for you upon the submission of the bundle of evidence, we will advise you the details of the interview (date, time and venue) and also provide you assistance with the interview preparation. 

Although we refer you to our sponsors, the selection of the candidate will be solely based on how you face the interview. This starts with the sponsors determining whether you would be a good candidate for the job. They usually have some common criteria across the organization (usually around cultural fit) with each location, department, or job role usually requiring some custom skills-based criteria. The candidates will be selected based on the ‘good impression’ or similar subjective feeling they got during the interview process. The sponsor would ask questions on topics to decide whether you would be a good choice for the position.

Your interview can be a combination of questions and assessments.  The assessment can be both tasks and activities that test your suitability for the job. You'll have the chance to demonstrate a wider range of skills than you would have been able to during a traditional face-to-face interview.

Visa Application Stage

APPLICATION TO THE HOME OFFICE

The Application Stage is all about guiding you successfully through the application process with minimal fuss. Contact a caseworker to discuss the fees involved.  

After you have been successful at the interview, the Sponsor will work with you to organise all of your paperwork, including your employment contract, pension plan, and other relevant documents. Once this is completed, the employer will issue us with a COS in order for us to proceed with your visa application process.

At this stage:

  • We would advice you and provide you assistance with the completion of the complex online VISA application form.

  • We would write a detailed cover letter in support of the application explicitly stating any relevant case law and official guidance which should be considered by the Home Office if appropriate.

  • Representation all the way to the decision on your immigration application and advice on any further steps that are needed.
